Premarital Planning Can Go A Long Way Toward Resolution
Every individual considering marriage enters the situation with a different personal history. Some persons may have accumulated considerable assets or property, some may have children from previous marriages, and some may have debt from a mortgage, a school loan or credit cards.
A premarital agreement, or prenuptial agreement, is a written contract signed by two people preparing to enter into marriage. By signing the agreement, one or both may be giving up certain rights that they might otherwise have had under the law in the event of divorce or death. At the Law Offices of Meridith A. Gregory, LLC, we help our clients develop premarital agreements that keep their financial assets and their families secure should their marriage dissolve.
How Prenuptial Agreements Are Formed
There are certain restrictions on what can go into premarital legal agreements e.g., you cannot waive child support obligations. For a premarital agreement to be valid, it must meet the following criteria:
- It must be in writing and signed by each of the future spouses
- There must be full and complete financial disclosure prior to signing
- Each party must have an attorney review the agreement before signing
- The document must be presented to both parties with sufficient time remaining before the wedding for independent legal review
Whether you need assistance drafting a prenuptial agreement or are seeking a review of such an agreement before you sign it, our firm is happy to advise you on how the document could impact your future.
