How Prenuptial Agreements Are Formed

There are certain restrictions on what can go into premarital legal agreements e.g., you cannot waive child support obligations. For a premarital agreement to be valid, it must meet the following criteria:

  • There must be full and complete financial disclosure prior to signing
  • Each party must have an attorney review the agreement before signing
  • The document must be presented to both parties with sufficient time remaining before the wedding for independent legal review
